ffl holders not recognizing c&r license |

hi, just go my license. went to gunbroker and sent questions to several sks owners(not chinese) to see if they accept c&r, 3/4 said no even for russian
sks's. several didn't even know what c&r was. is this a common problem?

I've found some dealers will only do transfers between 01 FFL holders. Others are knowledgeable enough about the C&Rs and have no problem with it.
Hit and miss.

Some of those people that are selling do not even have a FFL, they just have an arangment with an FFL holder and are dealing with the sales side of things.

I see those on there all the time. When I do I contact the seller and send him a nasty note. I've had a couple of them back down. Some just say it's there policy but can't answer why. I also contacted the ATF about this and they told me they were within their rights. It really PO's me to think that the federal government checked me out and authorized me to have the license and then these jerks come along and won't let you use it. I'm an American citizen, served my country, fought in a war. Who do they think they are to judge me. I think the ones who won't accept it are just plain lazy. That seems to be a contagion in America these days. James |

Also keep in mind that many FFL01 holders do not know everything about FFL's 01-07, they only know about a FFL01, or theirs. I found out a few weeks ago
that a good friend, and gun shop owner, knew almost nothing about a FFL03/C&R because he has never delt with one, or has never sent anything to anyone with
one. I found out that I actually knew more about a FFL03 than he did. Not that its his fault, but he has never had a reason to to know.

quite right, i just had one ffl01 dealer respond to my questions on why he wouldn't honor a c&r. he looked up the rifle in a catalog and it told him
the rifle ws c&r eligible so he said he guessed he could take my license. go figger!!!

I would suspect it is ignorance more than anything. I ask once and don't bother them anymore if they don't accept the 03. It is disappointing when you
see something you would buy, but the seller won't take an 03. I have also seen stuff go cheap that I knew would bring more if the seller would accept the
03; cause I would have paid more !! he he.

Although all posts could be correct here but did anyone stop to think of a conspirecy theory? FFL's make money on transfers up to $50 and maybe more.
They don't have to honor a C&R and give up that income and call it "not our policy" as rediculous as it sounds. A step on could do when
faced with a situation of non-acceptance is to be gentile and get them to admit the facts. Second, inform them that you price a collectable accordingly and
then counter offer that they pay all transfers. "Sir, you admit that you could (but won't) transfer to me directly, so why not pay for the transfer
to protect yourself since you are so concerned about legality"? Case won or closed is my conclusion when dealing with such a seller or FFL transferor.

i'm dealing with a seller now who originally said he would take a c&r & now wants a dealer ffl. the shop i use for transfers went up to $35 on the
1st of the year. they used to be $20. he's going to have to come up with free shipping or split the transfer fee or keep his rifle.
i don't sell often on gunbroker but when ever i encounter a seller who refuses to accept a c&r for something that is clearly c&r eligible or has a no c&r policy i block them from bidding on any of my auctions.

i just had a seller on gunbroker.com refuse to honor a c&r license for a yugo sks. when i e-mailed the listings from BATF c&r list, he e-mailed back
and said i was correct but that (and this interesting!!!) a BATF agent had visited their store and specifically told them the yugo sks was not c&r
eligible. go figger!!

I agree with dj about gunbroker. The only red feedback I have is when I refused to pay for a rifle that was C & R eligible, but the seller would not accept
my license. He had no reference in the listing about not accepting the 03 license, but after I won the bid and told him I would be using 03 he said no way. So
I didn't pay.
That is the only problem I have had so far. I just don't bother to even deal with anyone that won't honor my license.

I think we need to realize that if someone is not sure of the legality of something, they feel it is better to lose the sale than risk going to jail.

Look, I am only making a point here. Many States have very confusing laws. For example, you can ship a C&R to New York State, but not New York City.
Someone in Montana might have a very hard time trying to decide if an address is in New York City. Personally, I would not ship to Kalifornia, and I have a
C&R. But they made some crazy change in the law.
So instead of getting mad at someone, just spend your money elsewhere.You may know you are right, I may know you are right, but some people will just retreat when faced with a problem. It is not personal. |

Maybe getting "mad" is the wrong word. Frustrated with ignorance and/or lazyness is probably more appropriate. If one were in business to satisify
customers and earn a profit, then it would stand to reason that the laws would be learned or examined when confronted with an unusal case. "Trying to
decide" is the wrong approach based on my reasoning above. Learn (or at least try), then make an educated decision. To do otherwise is definitely
detrimental to both the business and the customer. You are right though, instead of getting frustrated, I just move on if the business owner won't even
listen let alone consider my case for doing business. I still try to leave my mark though. Maybe next time the business owner will learn how to learn. If
not, a smarter business man will survive, especially in a competitative environment.

Yes, but many offerings on Gunbroker are not from a business.
And like I said, in this environment, with Obama out to grab our guns, caution is going to be the word. THE ONE will probably be only too glad to give BATFE lots of money to chase down folks like you and me and throw us into jail. |

while i realize its the sellers choice not to accept a c&r on a firearm i still prefer not to do business with them & block them from bidding on my auctions. i can see on firearms that may require a little research on their part, or if they do not understand what a c&r is even after having it explained to them & shown links to the ATF's website. its the ones who are in it to make a profit & have a no c&r policy that annoy me. i know of several of these sellers who have some nice c&r guns that are no longer available at the wholesalers but are clearly c&r eligible. those guns would be sold if they didn't have that policy because i would have already bought them

dj, I share your sentiments. There have been quite a few pieces I would have bought if the seller honored my C & R. Like you indicated, some are not
available anymore from the distributors, certainly not in the nice condition I see on the auctions.
It does frustrate me when I am not allowed to exercise my right under the law to obtain that item with my license.

I live here in the PRK - and I know our dumb gun laws can be scary to those outside the state - but this "crazy change" DOES NOT AFFECT C & R's. Believe it or not, we are exempt. An out of state FFL or C & R and ship to us without doing anything different. Likewise, an out of state 03 FFL can ship to a California 01 FFL. The law requires 01 FFLs shipping to 01 FFLs to log onto a California DOJ website and obtain a verification number for every shipment they send into the state. The California 01 FFL must keep this number and they are the one in trouble if they recieve a shipment without a number. The stated reason is that gangs were forging FFLs to get guns shipped direct to them (plasable in this day and age). The NRA and firearms industry did not oppose or even tell us about it until it was done. Personally, I don't think the industry likes sites like gunbroker.com cutting into thier sales. I have friends who own a local shop and they charge $100.00 per gun to process an out of state transaction. Best price I can find is a local gunsmith with a 01 FFL who charges $60.00. It is in thier interest to keep all you out of state folks confused and worried. They sell more guns that way.
